The work is done. The payment is missing.
The work is finished. The invoice is overdue. Your client stops responding. What should you do next?
One invoice. A business decision.
Imagine a design studio in Albania with eighteen thousand euros outstanding. The project has been delivered, but payment has not arrived. Its next move needs evidence, a strategy and a realistic view of recovery.
Build the evidence before escalating
Start with the file: the contract, invoice, proof of delivery, acceptance and correspondence. Confirm the correct debtor, the payment terms and any complaints. An invoice matters, but the underlying agreement and performance matter too.
Make the demand clear
A formal demand should identify the debt, explain the basis of the claim and state what payment is requested. Keep evidence of delivery. Check default and limitation rules; do not assume informal reminders protect your position.
Choose the route before filing
Could negotiation or mediation resolve the dispute? Do your documents already qualify as an enforceable title? Some commercial debts have that route. If a claim is needed, check jurisdiction, any arbitration clause and the applicable time limits.
Protect what could be lost
If assets may disappear, assess urgent court protection before taking the next step. Interim measures require legal grounds and may require security. Evidence at risk can need separate preservation. Urgency changes the sequence; protection is never automatic.
Turn the file into a claim
If litigation is necessary, the claim must set out the facts, legal basis, requested relief and evidence. The debtor must have the opportunity to defend the case. Disputed performance, expert evidence or a counterclaim can change the strategy.
Measure the cost against the likely recovery
Budget for court fees, legal work and any experts or translations. Consider appeal and enforcement costs as well. Compare that investment with the amount realistically recoverable, not simply the face value of the invoice.
A judgment is a milestone
A favourable judgment is a milestone, not money in the bank. Check when it becomes enforceable, whether an enforcement order is needed, and the effect of any appeal or stay. Enforcement then follows the applicable bailiff procedure.
Recovery depends on more than winning
Actual recovery depends on reachable assets, competing claims and the debtor's financial position. Legal exemptions and insolvency can affect the outcome. A strong case cannot guarantee payment from a debtor who has nothing available to satisfy it.
Start with a recovery plan
For our studio, the first step is a focused assessment: the evidence, the right route, urgent risks, cost and collectability. The aim is a proportionate recovery plan, with settlement considered throughout.
