Aviation Law

Legal clarity for aviation matters.

Aviation operates across national rules, international conventions and commercial agreements. Understanding how these frameworks interact is essential to managing legal obligations, contractual relationships and disputes.

Tridens provides advice on aviation matters involving Albania, combining legal analysis with an understanding of the operational and commercial context. Our work spans regulatory interpretation, compliance, carrier liability, contract review, negotiations and representation.

A particular focus of the practice is Regulation (EC) No 261/2004 (EU261), alongside the Albanian Air Code (Law No. 96/2020) and Instruction No. 1 of 26 February 2013. We identify the rules applicable to each matter, assess the legal position and advise on an appropriate course of action.

Our practice

Compliance. Contracts. Disputes.

Assessment of legal positions, evidence and potential exposure; preparation of claims and responses; negotiation, settlement and representation in proceedings. The strategy reflects the applicable law, jurisdiction and commercial objectives.

05

Assistance with regulatory correspondence, enquiries and complaints involving the Albanian Civil Aviation Authority and other competent bodies. We advise on the legal issues, documentation and procedural response.

06

Cross-border coordination

Analysis of matters involving more than one legal system, including the applicable framework, jurisdiction and enforcement considerations. Where local advice is required abroad, we coordinate the legal work with appropriate counsel.

EU261

EU261 within the aviation framework.

EU261 requires a structured assessment of scope, obligations and liability. We address these questions in advisory work, compliance reviews and disputes.

Scope & obligations

Identify the relevant route, operating carrier, contractual arrangements and circumstances. Determine the applicable duties concerning information, care, reimbursement, rerouting and compensation.

Liability & defences

Examine the chronology, operational evidence, cause of disruption and reasonable measures taken. Assess statutory conditions, extraordinary circumstances and any applicable exceptions or reductions.

Procedure & resolution

Determine the relevant deadlines, jurisdiction and evidential requirements. Prepare a reasoned legal position and assess the appropriate response, negotiation or proceedings.

The applicable provisions inform our advice on regulatory duties, contractual obligations, liability and dispute resolution. The legal analysis takes account of the operative text and relevant dates.

Cross-border aviation

The interaction of legal frameworks.

An aviation matter may engage domestic legislation, European rules, international conventions and contractual provisions. Their application depends on the route, operating carrier, relevant dates and facts.

We distinguish the direct application of EU261 from the Albanian implementing framework. Matters involving the United Kingdom, the EEA, Switzerland or other jurisdictions require a separate assessment. International carrier-liability issues may also engage the Montreal Convention.

How we work

A clear position. A considered approach.

01

Define the matter

We establish the objectives, relevant parties and scope of the engagement, complete a conflict check and identify the regulatory, contractual or dispute issues requiring advice.

02

Assess the position

We examine the facts, documents, rights, obligations and available arguments. You receive a clear assessment of legal risk, the evidence needed and the practical options.

03

Agree and implement

We agree the scope, fees and external costs before acting. The work may involve compliance advice, contract review, a claim or response, negotiations or correspondence with an authority.

04

Resolve and follow through

We pursue the agreed course, whether an advisory outcome, settlement or proceedings. Where a matter belongs before a foreign court or authority, we assess the need for local counsel and coordinate the next steps.

Common questions

Clear answers before you act.

What does the Aviation Law practice cover?

The practice covers aviation regulation, compliance, EU261, carrier liability, commercial agreements and dispute resolution. Each engagement is scoped around the legal issue, the relevant jurisdiction and the objectives to be achieved.

How are EU261 and Albanian law assessed together?

We determine whether EU261 applies directly and separately examine the Albanian Air Code and Instruction No. 1 of 26 February 2013. The analysis considers the route, operating carrier, relevant dates and other conditions, without treating the different frameworks as interchangeable.

Can the practice assist with preventive compliance work?

Yes. We review terms, internal procedures and communications against the applicable requirements, identify legal gaps and advise on practical changes. The scope may include disruption-response procedures, complaint handling and the documentation needed to support decisions.

Does the practice cover contentious matters?

Yes. We assess evidence and legal exposure, prepare claims and responses, advise on settlement and provide representation where appropriate. We also consider jurisdiction, costs and enforcement prospects before recommending proceedings.

How are matters involving other jurisdictions handled?

We identify which elements require Albanian-law advice and where advice or representation in another jurisdiction is needed. Where appropriate, we coordinate with local counsel to maintain a consistent approach to the matter.
