The apartment

You have seen the apartment. The light. The terrace. The view. You have agreed the price. But what, exactly, are you buying?

Five checks behind the view

A beautiful home deserves a careful purchase. For a completed apartment in Albania, five checks should connect what you see with the rights you will acquire.

01 — Ownership and authority

First, confirm who owns the property and who can sell it. Check the seller's identity and authority, including relevant co-ownership, marital rights, inheritance, company approvals or a power of attorney. The person showing the apartment may not be the person entitled to transfer it.

Look behind the certificate

Then look behind the ownership certificate. Examine the documents through which title was acquired and transferred. Investigate relevant inconsistencies or competing claims. A current registry entry does not replace the underlying title investigation.

02 — Restrictions and other rights

Second, obtain current cadastral information and investigate restrictions. Mortgages, seizures, rights of way, leases or pending disputes can affect the transaction. Where a burden must be removed, agree a documented release mechanism. A promise that it will disappear is not enough.

03 — Match the property to the documents

Third, match the physical apartment to the registered unit. Check its number, floor, area and boundaries, alongside relevant construction, legalisation and use documents. A finished appearance does not resolve a documentary mismatch. Use an appropriate technical professional where measurements or building condition need assessment.

04 — What is included?

Fourth, define what is included. The terrace, parking space and storage may have different legal status. Distinguish private ownership, shared ownership and rights of use. Confirm access, common-area arrangements and charges. If land is included, assess the buyer's eligibility to acquire it.

Before a deposit

Before paying a reservation deposit, put the agreed protections into writing. Identify the exact property, the documents to be delivered, conditions for completion and what happens if those conditions fail. Record the refund terms, deadlines, fixtures and any agreed repairs.

05 — Contract, payment and registration

Fifth, coordinate the notarial sale, payment and cadastral registration. Confirm the applicable payment procedure and release conditions with your adviser and notary. Check taxes and filing documents, submit the transaction for registration, and follow it through to the updated cadastral record.

The final handover

At handover, record the condition, keys, meter readings and agreed outstanding items. Clarify utility and building-management balances and arrange the necessary account changes. Keep the contract, payment evidence, registration documents and handover record together.

Know what you are buying

The result should be clear: what you are buying, which rights come with it, and what must be resolved before completion. Enjoy the view. Understand the purchase.
