Hiring Your First Employee in Albania: Contracts, Payroll and Legal Requirements

Before day one: a practical guide for founders and employers building a team in Albania.

Hiring your first employee in Albania turns a business plan into a working organisation. Before the first day, the employment contract, employee declaration, payroll arrangements and workplace preparation need to fit together. If the recruit is a foreign national, permission to work is another part of that preparation.

The questions often arrive together: does the contract need to be in writing? When must the employee be registered? Is the agreed salary gross or net? Can someone start while their residence application is pending?

This guide explains the main steps for a private business making its first hire in Albania. It focuses on an ordinary employment relationship; sector-specific rules, collective agreements and the employee’s circumstances can require additional measures.

1. Prepare an employment contract that fits the role

The Albanian Labour Code requires a written employment contract. Article 21 identifies the information it should contain, including the parties, workplace, duties, start date, pay and payment date, normal weekly hours, paid leave, notice and probation. A fixed-term contract must also identify its duration. Applicable collective agreements and disciplinary arrangements require attention too. [1]

Complete the agreement before work begins. The Code contains a limited exception for special, justified circumstances, requiring the written contract within seven days of employment; this should not become the business’s routine onboarding process.

Use the contract to resolve practical questions while expectations are still clear. Who supervises the employee? Where will they work? Are bonuses discretionary or linked to defined results? Who approves overtime or expenses? If the role involves confidential information or company equipment, document the relevant responsibilities and handover arrangements.

A template used by a foreign parent company may be a useful starting point, but it needs to be adapted to Albanian law and the actual working arrangement. A signature does not make a clause that conflicts with mandatory employee protections enforceable.

Indefinite or fixed-term employment?

Indefinite employment is the general starting point under Article 140. A fixed term must be justified by objective reasons connected with the temporary nature of the assignment. Wanting to “see how things go” is not, by itself, a sound reason to treat an ongoing position as temporary. [1]

Probation is still employment

Probation is not an unpaid trial or a reason to delay registration. Check the rules applicable to the contract, including any previous employment in the same work and any agreement reducing or excluding probation. Record the terms clearly and plan performance reviews early enough to make an informed decision. The rules for ending probationary employment also require attention; probation does not mean that all legal protections disappear.

2. Register the employee before work begins

For a business that is already registered and hires a new employee, the tax administration’s guidance generally requires the employee declaration at least one calendar day before work begins. This is a separate step from the first payroll declaration. Do not wait until the end of the month to tell the tax administration that someone has started work. [2]

Initial business registration has separate procedures and deadlines for declaring employees. A company being incorporated and a company that already exists should therefore not automatically follow the same timetable. [3]

Before confirming the start date, identify who will make the declaration, collect the required employee details and confirm that the necessary electronic filing access is available. Keep the submission confirmation in the employment file and check that the declared information matches the contract.

Practical example: if an existing company wants an employee to start on Monday, leaving registration until Monday morning is too late for the general one-calendar-day rule. Arrange the submission ahead of time and verify acceptance, rather than relying on a last-minute weekend filing.

3. Understand salary and payroll costs in Albania

“We agreed a salary of €1,000” leaves an important question unanswered: is that the employee’s gross pay, the amount they expect to receive, or the employer’s budget? Put the answer in writing before making an offer.

Three figures to distinguish in the hiring budget
FigureWhat it means
Gross salaryPay before the employee’s applicable tax and contribution deductions.
Net salaryThe amount remaining after applicable employee deductions.
Employer’s total costGross salary plus employer contributions and other agreed employment costs.

Payroll must address employment-income tax and social and health insurance contributions. The employer’s responsibilities include calculating, withholding where required, declaring and paying the relevant amounts, and keeping supporting records. Using an accountant or payroll provider does not remove the need for clear responsibility within the business. [3]

The 2026 position: the General Directorate of Taxes states that the national minimum monthly wage is ALL 50,000 from 1 January 2026. Contribution thresholds also changed. Check the current rules for the actual working arrangement and payroll period; do not reuse an older salary calculation without reviewing its assumptions. The social-insurance ceiling should not be assumed to cap every payroll charge. [4]

Build a short payroll calendar: when attendance and variable pay are confirmed, who checks the calculation, when the salary is paid, and when declarations and statutory payments fall due. Reconcile the records after each cycle. Bonuses, benefits, absences and additional employment can affect the calculation.

4. Set working hours and leave correctly

The Labour Code sets the normal working week at no more than 40 hours. Overtime, rest periods, night work and work on public holidays are governed by additional rules; the normal weekly limit should not be confused with an unrestricted entitlement to require extra work. [1]

The minimum annual paid leave is 22 working days for a full working year, following the 2024 amendment. Entitlement is proportionate where the employment relationship has lasted less than a full working year. Public holidays are not included in annual leave. Older summaries referring to four calendar weeks should not be copied into a new contract without checking the amended text.

Turn these requirements into a workable routine. Explain how leave is requested, how working time is recorded and who authorises extra hours. A small team needs arrangements that people can follow consistently, rather than a lengthy handbook that no one uses.

5. Prepare the workplace and employment records

A desk, laptop and email address are only part of the preparation. Employers need to assess workplace risks, take appropriate preventive measures and provide relevant safety information and training. An office, a construction site and a hospitality business will not require identical measures. [5]

For the individual role, prepare the equipment, system permissions, supervision and induction. Give access according to the work the person will actually perform. Decide how confidential information, company devices and business records will be handled.

As a practical records checklist, keep the signed agreement and amendments, employee declaration, payroll and payment records, working-time and leave records, and relevant induction documentation. Restrict access to personal information and establish appropriate retention arrangements. This checklist is a starting point, not a substitute for a business-specific compliance review.

6. Check work and residence requirements for foreign employees

Hiring a foreign national in Albania requires an assessment of their nationality, existing status, proposed work and intended stay. Depending on the circumstances, a single permit, employment approval, a visa or other steps may be relevant; exemptions also need to be assessed correctly. [6]

A signed employment contract, visa-free entry or a pending application should not be treated as sufficient evidence that work may begin. Establish what authorises the proposed employment and agree a start date that reflects it. Check any conditions linking the permission to a particular employer or activity, as well as expiry and renewal requirements.

Begin this assessment while discussing the offer, not the day before arrival. Employment documentation, payroll registration and immigration permission are related, but each serves a different purpose. Our guide to residence through employment in Albania explains the immigration side in more detail.

7. Use a first-day checklist with named responsibilities

The most common organisational weakness is an assumption that someone else has completed the next step. Assign an owner and a completion check to each item:

  1. Contract: the terms reflect the role, and both parties have the agreed document.
  2. Declaration: the applicable filing has been completed on time and confirmation retained.
  3. Payroll: salary, deductions, employer cost and the first payment cycle have been checked.
  4. Workplace: equipment, access, safety arrangements and induction are ready.
  5. Eligibility: any required immigration permission has been established for the proposed work.

Before the first payroll is finalised, check the actual start date, attendance and any changes to the offer. A well-prepared first hire creates a process that can support the next five employees without recreating the paperwork each time.

Frequently asked questions

Can I register an employee when I run the first payroll?

For an already registered business taking on a new employee, the general declaration deadline is at least one calendar day before work begins. The payroll cycle is not a substitute for that declaration. Initial business registration and special circumstances require their own check.

Can a new employee work unpaid during probation?

Ordinary probationary employment remains paid employment. Probation should not be used to postpone the contract, employee declaration or payroll responsibilities.

Does every first hire need a fixed-term contract?

No. Indefinite employment is the general starting point. A fixed term requires objective justification connected with the temporary assignment; being the company’s first employee does not supply that justification.

Is an employment contract enough for a foreign employee to start?

No. The contract forms part of the employment arrangements, but the person’s right to carry out the work must be assessed separately under the applicable immigration rules.
